Terms of service

1. Agreement to these terms

These terms of service are a legal agreement between you and Writibot, Inc., the company behind Writibot, an AI writing workspace. In this document we and us mean the company; you means the person or organisation using the service.

By creating an account, starting a trial or subscribing to a plan, you confirm that you have read these terms and agree to be bound by them. Our privacy policy explains how we handle personal information and forms part of this agreement. If you do not agree with what follows, please do not use Writibot.

2. Who can use Writibot

You must be at least 16 years old to use Writibot. If you are under the age of majority where you live, you may only use it with the involvement of a parent, guardian or teacher who accepts these terms on your behalf. We do not knowingly provide the service to children under 16.

If you are accepting these terms for a company, agency, school or other organisation, you confirm that you have authority to bind it, and that organisation is then responsible for everything done through its account. You may not use Writibot where the law prohibits us from providing it to you, including under trade sanctions or export controls.

3. Your account and security

Register with accurate details and keep them current, so we can reach you about billing and security. Keep your credentials confidential, choose a strong and unique password, and switch on any extra security options we offer.

You are responsible for everything that happens under your account, including work done by anyone you invite, and seats are for named individuals rather than a whole team. If you think your account has been accessed without your permission, write to us at hello@writibot.com straight away. We may ask you to verify your identity before acting on a request about an account.

4. Plans, billing and renewals

Writibot is offered on free and paid plans. Paid plans are billed in advance, monthly or annually, using the payment method you provide. By subscribing you authorise us and our payment processor to charge that method for your plan plus any applicable taxes, until you cancel.

Free trials. A trial runs for the period shown at sign-up. When it ends your subscription starts automatically on the plan you selected and your payment method is charged, unless you cancel first. If you never added one, nothing is charged and your workspace moves to the free plan with your drafts intact.

Renewals and taxes. Subscriptions renew automatically at the price current at renewal until you cancel, and we email you before an annual renewal. Prices exclude VAT, sales tax and similar duties; where we are required to collect tax, it is added at checkout from the billing details you give us.

Upgrades, downgrades and failed payments. Upgrades apply immediately, prorated for the rest of the period. Downgrades apply at your next billing period and can reduce limits such as seats or saved presets, so export anything you want to keep first. If a payment fails we retry it and tell you; if it stays unpaid we may pause paid features. We give at least 30 days notice before a price change reaches your renewal.

5. Cancellation and refunds

You can cancel at any time from your billing settings. Cancelling stops the next renewal rather than cutting short the period you have already paid for, so you keep full access until it ends and then move to the free plan.

Except where the law provides otherwise, payments are non-refundable and we do not refund partial periods or unused seats. Even so, we would rather be fair than technically correct: if you were charged for a renewal you did not intend and have barely used the service since, write to us within 14 days and we will look at it case by case. If you close your account outright, export what you want first, because we then remove content in line with our privacy policy.

6. Acceptable use

Writibot is a tool for writing, and we want it to stay useful and safe for everyone who uses it. You agree not to:

• create, store or publish unlawful content, or content that harasses, defames, threatens or exploits other people
• send spam, bulk unsolicited messages or deceptive marketing produced with the service
• impersonate a person, brand or organisation, or misrepresent your affiliation with anyone
• break, probe or overload the service, or work around rate limits, plan limits and security measures
• resell, sublicense or expose raw model access, or use Writibot as a pass-through for another product
• scrape, crawl or bulk-extract the service, its templates or its output by automated means we have not documented
• present generated output as human-written where that is illegal or deceptive, such as in academic submissions, regulated disclosures or customer reviews
• use the service to build a competing product, or to train another model on its output, without our written permission

We investigate suspected misuse and respond proportionately, which may include removing content, limiting features or suspending an account under section 15.

7. Your content and who owns it

You keep ownership of everything you put into Writibot: prompts, briefs, source material, notes and uploads. As between you and us, you also own the drafts and rewrites the service produces from that input, and you are free to use them commercially.

To run the service we need one narrow permission. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display and process your content, solely to operate and secure the service, support you and comply with the law. It ends when you delete the content or close your account, subject to the short backup windows described in our privacy policy, and we do not train models on your content by default.

You are responsible for having the rights to whatever you feed in. Because generative models produce similar text for similar prompts, your output is not exclusive to you and another user may receive something comparable.

8. How AI output works and your responsibility to review it

Writibot generates text with AI models. Those models predict likely wording; they do not check facts, verify sources or understand your circumstances. That has honest consequences you should plan around:

• output can be inaccurate, outdated, incomplete or confidently wrong, particularly with names, numbers, dates, quotes and citations
• output can resemble text that already exists, because phrasing that sounds natural to a model is often phrasing that is common
• output is not legal, medical, financial, tax or other professional advice, and is no substitute for a qualified person who knows your situation
• output can carry bias present in training data, or read as tone-deaf in a context the model cannot see

Writibot includes built-in checks that help you spot passages which look unoriginal or otherwise risky before you publish. They are an aid to your own judgement and nothing more. They can miss things, they can flag passages that are perfectly fine, and they do not guarantee that a piece of writing is original, accurate or safe to publish.

You decide what to publish, so read what you are about to send. Review, fact-check and edit output before it goes anywhere that matters, and take extra care in academic, regulated, medical or safety-related contexts. You are the author and publisher of the work you ship.

9. Our intellectual property

The service, including its software, interface, templates, tone and style presets, prompt libraries, documentation, and the Writibot name and logo, is owned by Writibot, Inc. or our licensors. Nothing in these terms transfers that ownership to you.

While your account is in good standing you have a limited, non-exclusive, non-transferable and revocable right to use the service for your own writing, including commercial work for your organisation or your clients. You may not copy, reverse engineer or attempt to derive the source of the service, remove proprietary notices, or use our brand in a way that implies an endorsement we have not given. If you send us feedback, we may use it to improve Writibot without obligation, confidentiality or payment.

10. Third-party services

Writibot runs on infrastructure we do not own, including cloud hosting, AI model providers, payment processing and email delivery. We choose those providers carefully and describe the categories we rely on in our privacy policy, but we cannot control their availability or the terms they set.

You may also connect Writibot to tools you already use, or paste output elsewhere. What happens in those tools is governed by their terms and policies, not ours, and we are not responsible for them or for any loss you suffer through them.

11. Service availability and changes

We work hard to keep Writibot fast and available, but no online service is up every second. Access may be interrupted by maintenance, upgrades, provider outages or events outside our reasonable control, so we do not promise uninterrupted or error-free operation and, unless we have signed a separate agreement with you, we offer no contractual uptime guarantee.

Writibot also changes: we add features, refine presets and occasionally retire what is not earning its place. If we remove or materially degrade a feature central to a paid plan, we will give reasonable notice by email or in the product, and you may cancel and ask for a prorated refund of the unused part of your term.

12. Disclaimers

To the fullest extent permitted by law, the service is provided as is and as available, without warranties of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the service will meet your requirements, that it will be uninterrupted or secure, or that any output will be accurate, original, complete or suitable for what you have in mind. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here removes consumer rights that cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, neither Writibot, Inc. nor its directors, employees or suppliers will be liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenue, business, goodwill, or the loss or corruption of data, even if we were told such damages were possible.

Our total aggregate liability relating to these terms or the service, on any legal basis, is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars. These limits do not apply to liability that cannot lawfully be limited, including fraud and death or personal injury caused by negligence.

14. Indemnity

If someone brings a claim against us because of the way you used Writibot, you agree to defend us and cover the cost. You will indemnify and hold harmless Writibot, Inc., its affiliates and its people from third-party claims, damages, losses, liabilities and reasonable legal fees arising out of your content, your use of the service in breach of these terms, or your violation of any law or of the rights of anyone else.

We will tell you promptly about any claim we want covered, let you control the defence with counsel of your choice subject to our reasonable approval, and cooperate at your expense. You may not settle in a way that admits fault on our behalf without our written consent.

15. Suspension and termination

You can stop using Writibot whenever you like and close your account from your settings. We may suspend or terminate an account if you materially breach these terms, if an invoice stays unpaid after we have chased it, if your use puts the service or other users at risk, or if the law requires us to act. Where it is practical and safe we will warn you first and give you a fair chance to put it right; in urgent cases we may act immediately and explain afterwards.

When an account ends your right to use the service ends with it, so export anything you want to keep beforehand. The sections that should outlive this agreement, including content ownership, disclaimers, liability limits, indemnity and governing law, continue to apply.

16. Changes to these terms

We update these terms from time to time, for example when we ship a significant feature, change how billing works, or need to reflect a new legal requirement. The date at the top of this page shows when the current version took effect.

If a change is material we will give you at least 30 days notice by email or through the product before it takes effect. Continuing to use Writibot after that date means you accept the updated terms; if you do not accept them, cancel before the effective date and the previous version governs your use until then.

17. Governing law and disputes

These terms, and any dispute arising from them or from your use of Writibot, are governed by the laws of the State of Delaware in the United States of America, without regard to its conflict-of-law rules. You and Writibot agree that the courts located in Delaware have exclusive jurisdiction over any dispute, and each of us consents to personal jurisdiction there.

Before filing anything, please talk to us. Most problems turn out to be misunderstandings and are quicker to fix by email, so describe the issue and what you would like to happen, and give us 30 days to work it through. If you use Writibot as a consumer, nothing here removes the protection of the mandatory laws of the country where you live.
